Terms of Service

1. Acceptance of Terms

Jiwa AI is operated by CV Kudapan Anak Bangsa (doing business as Imaji AI / Jiwa AI), registered in Indonesia with NIB 1211250010614, located at Jl. Boulevard Raya Blok 19 No. 1, 3, Desa/Kelurahan Pegangsaan Dua, Kec. Kelapa Gading, Kota Adm. Jakarta Utara, Provinsi DKI Jakarta 14250. By accessing jiwa-studio.space, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

By using Jiwa AI, you also agree to be bound by Meta's Platform Terms, Instagram's Terms of Use, and Google's Terms of Service to the extent they apply to your use of those platforms through our service.

2. Service Description

Jiwa AI is an AI-powered influencer content platform that automates content creation and publishing for businesses. Our service includes:

  • Brand analysis from your website or Instagram profile
  • AI-generated content calendars with captions, hashtags, and images
  • Content review and approval workflows
  • Direct publishing to your connected Instagram Business account
  • WhatsApp notifications for content previews (optional)

3. Account Registration

To use Jiwa AI, you must sign in using Google OAuth. By signing in, you represent that:

  • You are at least 18 years old or the age of majority in your jurisdiction.
  • The information you provide is accurate and complete.
  • You are responsible for maintaining the security of your account.
  • You will not share your account access with unauthorized individuals.

4. Instagram Integration

When you connect your Instagram Business account to Jiwa AI:

  • You authorize us to access your Instagram profile data and publish content on your behalf, as described in our Privacy Policy.
  • You retain full responsibility for all content published to your Instagram account, including compliance with Instagram's Community Guidelines.
  • You may disconnect your Instagram account at any time via Instagram Settings or by contacting us.

5. TikTok Integration

When you connect your TikTok Business account to Jiwa AI:

  • You authorize us to access your TikTok profile data and publish content on your behalf via the TikTok for Business API.
  • You retain full responsibility for all content published to your TikTok account, including compliance with TikTok Community Guidelines and TikTok for Business Terms of Service.
  • We request the following TikTok API scopes: video.publish (to publish videos to your TikTok account) and user.info.basic (to access your TikTok profile information).
  • You may disconnect your TikTok account at any time via TikTok Settings > Apps and Websites or by contacting us.

6. Content Ownership & Licensing

  • Your Content — You retain ownership of all business data, product images, and other content you provide to Jiwa AI.
  • AI-Generated Content — Captions, images, and other content generated by our AI are licensed to you for use in connection with your business. You may use AI-generated content for any lawful business purpose.
  • License to Us — You grant Jiwa AI a non-exclusive, worldwide license to process your data solely for the purpose of providing the service (content generation, analysis, and publishing).

7. AI-Generated Content Disclaimer

Content created by Jiwa AI is generated by artificial intelligence and may not always be accurate, appropriate, or aligned with your brand. You acknowledge that:

  • All content goes through a review and approval step before publishing. You are responsible for reviewing content before approving it for publication.
  • Jiwa AI does not guarantee specific engagement metrics, follower growth, ROAS, or any other performance outcome.
  • AI-generated images may not perfectly represent your products or brand. Always verify generated content before publishing.

8. Credits & Payments

  • Jiwa AI operates on a credit-based system. Content packages include a specified number of posts and/or stories.
  • Payments are processed through Airwallex in Indonesian Rupiah (IDR) or Singapore Dollar (SGD).
  • Credits are consumed when content is generated and are non-refundable once used.
  • Unused credits remain available until your account is terminated.
  • Package details and pricing are as described at the time of purchase.

9. Prohibited Uses

You agree not to:

  • Violate Instagram's Terms of Service, Community Guidelines, or any applicable Meta policies.
  • Submit misleading, fraudulent, or inaccurate business information.
  • Use the service to create or publish unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
  • Attempt to circumvent the credit system or exploit the service.
  • Use automated means (bots, scrapers) to access the service beyond its intended use.
  • Reverse-engineer, decompile, or attempt to extract the source code of our AI models or proprietary systems.

10. Third-Party Services

Jiwa AI integrates with third-party services including Meta/Instagram, TikTok, Google, Airwallex, and others. Your use of these services through our platform is subject to their respective terms and policies. We are not responsible for the practices or content of third-party services.

11. Limitation of Liability

Jiwa AI is provided "as-is" and "as-available" without warranties of any kind, either express or implied. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • We are not responsible for changes to the Instagram Graph API, TikTok for Business API, Meta or TikTok platform policies, or other third-party services that may affect the functionality of our service.
  • Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

Either party may terminate your account at any time. We may suspend or terminate your access if you violate these Terms or engage in prohibited conduct.

Upon termination, your data will be handled in accordance with our Privacy Policy, including the data deletion procedures described therein.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Indonesia.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Your continued use of Jiwa AI after changes are posted constitutes acceptance of the updated Terms.
